Associate Professor of Government Gbemende Johnson’s legal note on a Supreme Court Freedom of Information Act (FOIA) case was recently published in The Justice System Journal.
In “The Deliberative Process Privilege and the Freedom of Information Act: U.S. Fish and Wildlife Service v. Sierra Club (2021),” Johnson discussed a ruling about the release of certain records in a 2014 FOIA request by the Sierra Club for records from the U.S Fish and Wildlife Service and the National Marine Fisheries Service. On appeal, the Supreme Court upheld part of the original lower court ruling while also reversing in part and remanding the case.
